Texas Jury Awards $109,383 in Three-Car Rear-End Collision

A three-car rear-end collision occurred involving the plaintiffs' vehicle and a small school bus driven by the defendant. The plaintiffs, occupants of the middle vehicle, subsequently filed a lawsuit seeking damages for general bodily injuries, including neck and back pain. The case proceeded to trial on the issue of damages only, with liability for the collision not disputed.

A jury unanimously found in favor of the plaintiffs. The first plaintiff was awarded $10,000 for past physical pain and mental anguish, $5,000 for future physical pain and mental anguish, $22,400 for past loss of earning capacity, and $17,437 for past medical care. The second plaintiff received $5,000 for past physical pain and mental anguish, $7,000 for future physical pain and mental anguish, and $42,546 for past medical care. The jury awarded no damages for past or future physical impairment to either plaintiff. Prior to trial, the parties had engaged in mediation.
