Lake Success Jury Awards $25,000 in Rear-End Collision

A motor vehicle collision occurred on Lakeville Road in Lake Success when the defendant's vehicle struck the plaintiff's car from behind on January 24, 2018. The plaintiff, a 59-year-old insurance broker, alleged the defendant negligently failed to slow or stop, causing the rear-end impact. The defendant reportedly exited the vehicle, checked for damage, and then fled the scene. The plaintiff took photos, and police later located the defendant.

The plaintiff subsequently filed a negligence lawsuit, claiming the force of the impact resulted in significant and permanent post-traumatic injuries, including cervical and lumbar disc herniations, shoulder tears, and a concussion. The plaintiff underwent trigger point injections and chiropractic treatment, presenting testimony from a treating chiropractor who affirmed the serious and permanent nature of the injuries. The defendant disputed the extent of the damages, arguing the plaintiff's injuries were not serious, had resolved without permanency or disability, and only included resolved sprains and strains. A medical expert for the defendant opined there were no signs of permanent injury or shoulder tears.

Prior to trial, the defendant offered $10,000 to settle the matter, which the plaintiff declined. The parties then entered into a pre-trial high/low agreement, setting a maximum recovery of $25,000 and a minimum of $10,000. A jury found in favor of the plaintiff, awarding $220,000 in damages, with $60,000 for past pain and suffering and $160,000 for future pain and suffering. Due to the high/low agreement, the plaintiff recovered the maximum amount of $25,000.
