Case Overview
In Venice, a plaintiff was involved in two separate motor vehicle accidents. The first occurred on November 26, 1999, at the intersection of Highway 41 and Shamrock when a vehicle operated by one defendant and owned by a corporate defendant rear-ended the plaintiff's vehicle. A second collision took place on December 15, 2002, when another defendant's vehicle collided with the plaintiff's. The plaintiff subsequently filed suit against the drivers and vehicle owner involved in the collisions, and also pursued a claim against an insurance provider for alleged failure to pay uninsured/underinsured motorist benefits under a contract.
During the trial, the jury determined that the plaintiff did not suffer a permanent injury within a reasonable degree of medical probability as a result of the accident. Following the verdict, the plaintiff's motions for a new trial and for additur were denied. The case is currently on appeal.
