Case Overview

In July 1999, a multi-vehicle collision occurred near the intersection of I-10 East and I-95 in Jacksonville, Florida. The plaintiff, traveling on the highway, stopped for traffic and was rear-ended by a motorist, identified as an underinsured driver. The impact pushed the plaintiff's vehicle into the car stopped in front. The defendant motorist admitted negligence in causing the accident. The plaintiff subsequently filed a claim, asserting injuries and seeking coverage under an uninsured/underinsured motorist policy with the defendant insurer.

The central dispute revolved around the nature and permanence of the plaintiff's alleged injuries. The plaintiff presented medical experts in neurology, pain management, family practice, and physical medicine and rehabilitation. The defense called an orthopedic surgery expert to testify.

After considering the evidence, the jury determined that the defendant motorist's negligence was a legal cause of damage to the plaintiff. However, the jury also found that the plaintiff did not suffer a permanent injury, within a reasonable degree of medical probability, as a result of the accident.
