Florida Jury Finds Permanent Injury in Rear-End Collision

A four-vehicle collision occurred on I-95 in Florida on May 29, 2001, at approximately 6:30 p.m. The plaintiff's vehicle, which was the third in the sequence, was rear-ended by a fourth vehicle. The driver of the fourth vehicle was acting within the course and scope of employment for the defendant at the time of the incident. The plaintiff subsequently filed a lawsuit alleging permanent injury resulted from the collision.

During the proceedings, medical experts provided testimony regarding the plaintiff's condition. An orthopedic surgeon from West Palm Beach testified for the plaintiff, asserting a permanent injury, while an orthopedic surgeon from Atlantis testified for the defense. A jury ultimately determined that the plaintiff sustained a permanent injury, within a reasonable degree of medical probability, as a direct result of the accident. At the time of this report, the defendant's motion for a new trial was pending. The driver of the second vehicle involved in the collision had previously settled with the plaintiff for a confidential amount.
