Texas Jury Awards $40,387 in Rear-End Collision Negligence

On February 9, 2018, a rear-end collision occurred on Bob White Drive involving a vehicle driven by the plaintiff driver, carrying a plaintiff passenger, and one operated by the defendant driver. The incident took place as the plaintiffs' vehicle slowed for a left turn. The plaintiffs sued, alleging the defendant driver's negligence, including excessive speed and failure to maintain a safe distance. They sought damages for various physical and economic injuries.

The defendant driver denied the allegations, asserting no proximate causation, claiming the plaintiff driver failed to exercise due care, and arguing the accident was unavoidable or caused by others. The defense also contended that damages were pre-existing and raised a contributory negligence defense.
