Texas Judge Awards $11,906.94 in Rear-End Collision

On January 2, 2020, a vehicle operated by the plaintiff was involved in a chain-reaction rear-end collision on W FM 1960 in Texas. The incident occurred when a defendant driver allegedly failed to control speed, striking the vehicle in front, which then collided with the plaintiff's car. The plaintiff filed a lawsuit on June 12, 2020, alleging the defendant driver was negligent in several ways, including failing to maintain proper lookout and control speed. The plaintiff also claimed the defendant vehicle owner was negligent in entrusting the vehicle.

After difficulties serving the defendants, the court granted the plaintiff's motions for substitute service of process. The plaintiff later filed medical billing and records affidavits. The defendants failed to respond to the lawsuit, leading the court to enter a default judgment on April 26, 2021, in favor of the plaintiff. A subsequent judgment on May 10, 2021, awarded the plaintiff $3,254.94 for medical bills, $3,512.00 for property damages, $5,000.00 for physical pain and suffering, and $140.00 for lost wages, totaling $11,906.94.
