Texas Court Awards $21,287 After Rear-End Collision

On May 31, 2016, a plaintiff was involved in a motor vehicle accident on I-10 N. Service Road. The plaintiff alleged that the defendant negligently struck the rear of the plaintiff's vehicle by failing to control speed, maintain a proper lookout, apply brakes, keep an assured clear distance, maintain control, and exercise ordinary care. The plaintiff sought compensation for past and future medical expenses, pain and suffering, physical impairment, disfigurement, lost income, property damage, and court costs.

The defendant filed a general denial, arguing that the plaintiff was contributorily negligent and that any medical expense recovery should be limited to the amount actually paid. The case proceeded with various pre-trial motions.

On September 23, 2021, the court rendered judgment in favor of the plaintiff. The judgment awarded the plaintiff $15,103.28 in actual damages, $3,700.30 in pre-judgment interest, and $2,483.80 in taxable costs. The judgment also included post-judgment interest at an annual rate of 5.5%. The case was ultimately resolved through a Consent Judgment, which was formally processed in December 2021.
