Case Overview

On October 24, 2013, a pedestrian was struck by a vehicle while crossing South St. Mary's Street in downtown San Antonio. The plaintiff, an attorney, was in a crosswalk with a walk light when the defendant attempted a left turn from East Commerce Street onto South St. Mary's Street in a 2013 Toyota Highlander and struck her. The plaintiff filed a lawsuit alleging the defendant was negligent by failing to keep a proper lookout, failing to yield the right of way, and making an unsafe left turn. The defendant did not strongly dispute liability.

The plaintiff claimed a fractured fifth metatarsal in her left foot, a lumbosacral sprain, disc bulges, and a small disc protrusion, among other contusions. Her treatment included emergency room visits, physical therapy, and multiple MRIs over several years, continuing after a later motor vehicle accident in 2015. The plaintiff sought $37,000 for past medical bills, $40,000 for future medical bills, $1,600 for past lost wages, and $7,200 for future lost wages, in addition to damages for pain and impairment. A defense expert, an orthopedic surgeon, opined that the accident caused only a foot fracture and possibly a moderate sprain, which would have healed within two to three months, and that several MRIs were medically unnecessary.

The parties settled the case in mediation for $130,000.
