Midlothian, Texas Jury Awards $6,597 in Rear-End Collision

A driver was rear-ended on July 30, 2014, at the intersection of Highway 287 and Plainview Road in Midlothian while stopped at a red light. The plaintiff alleged neck and back injuries from the collision. The plaintiff subsequently sued the other driver for negligent vehicle operation. The defendant conceded liability, and the case proceeded on the issue of the plaintiff's claimed injuries and damages.

The plaintiff presented to an emergency room two days after the accident with neck and back pain, later diagnosed as soft-tissue injuries, and received four months of chiropractic care. The plaintiff sought damages for past medical costs, pain, mental anguish, and physical impairment, claiming residual pain and activity limitations. The defense argued the plaintiff sustained no injuries from the collision and lacked compelling evidence for impairment or anguish. After a one-day trial, a jury awarded the plaintiff $6,597 for past medical costs.
