Kilgore Jury Awards $5,224 in Rear-End Collision for Negligence

In January 2018, a compact car driven by the plaintiff was rear-ended by a vehicle operated by the defendant in Kilgore. The plaintiff subsequently filed a lawsuit, alleging the defendant was negligent in operating her vehicle. The defense stipulated to liability, though evidence was presented that the defendant initially left the accident scene before reporting it to police approximately 20 minutes later.

The plaintiff claimed injuries to his back, neck, and a shoulder, stating an ambulance transported him to the emergency room where X-rays were unremarkable. He was prescribed pain medication and released, later reporting sprains and strains. After three weeks of follow-up visits with a company doctor, his pain levels significantly decreased, and he sought no further treatment. The plaintiff requested $4,724 for past medical expenses and additional damages for past pain, anguish, and impairment. The defense argued that any injuries sustained were minor, resolved quickly, and resulted from a low-impact collision.

After a one-day trial, a jury deliberated for 30 minutes. The jury returned a unanimous verdict, awarding the plaintiff $5,224. The final judgment, including prejudgment interest and taxable costs, amounted to $6,278.29.
