Houston Motor Vehicle Negligence Award of $230,843 Upheld

A motor vehicle accident occurred on March 6, 2017, resulting in injuries to the plaintiff. The plaintiff subsequently filed a personal injury lawsuit against the defendant in a Houston, Texas court, alleging negligence and seeking compensation for medical expenses incurred as a result of the incident.

The plaintiff presented evidence of sustained injuries and designated an expert witness, a physical medicine and rehabilitation physician, to testify about the diagnosis, treatment, prognosis, and the necessity and reasonableness of related medical charges. The defendant denied the allegations and asserted defenses including contributory negligence, claiming the plaintiff suddenly applied brakes and failed to mitigate damages. The defense further contended that some medical treatment was not reasonable or necessary, that MRI findings indicated degenerative changes rather than acute injuries, and that the medical charges were excessive. The defendant also presented a counter-affidavit from an orthopedic surgeon challenging the necessity and cost of the plaintiff's medical care.

After a multi-year litigation process, the case proceeded to trial. On September 28, 2022, a jury unanimously found the defendant's negligence caused the plaintiff's injuries and awarded $209,669 in damages, comprising $36,539 for past medical expenses and $173,130 for future medical expenses. The court entered a corrected final judgment on February 10, 2023, totaling $230,843.61, which included damages, court costs, and pre- and post-judgment interest. The defendant appealed to the Fourteenth Court of Appeals, challenging the sufficiency of evidence for the medical expense award. On March 5, 2024, the appellate court affirmed the trial court's judgment in its entirety.
