Harris County Rear-End Collision Settles, Amount Undisclosed

On July 4, 2018, a motor vehicle collision occurred in Harris County, Texas, involving the plaintiff and a minor plaintiff. The plaintiffs' August 2020 complaint alleged the defendant negligently rear-ended their vehicle in rainy weather. The plaintiff claimed the defendant failed to maintain proper lookout, speed, and safe distance, resulting in severe injuries and seeking damages for medical expenses and pain.

The defendant filed a general denial, asserting an unknown vehicle struck her from behind, pushing her into the plaintiffs' vehicle before fleeing. The court granted the defendant's motion to designate this unknown driver as a responsible third party. The defendant later filed a motion for summary judgment, which argued a lack of evidence for the plaintiffs' negligence or causation claims, but the court denied it.

The parties subsequently reached a settlement. A Guardian Ad Litem was appointed for the minor plaintiff and, following review, recommended approval.
