Harris County Rear-End Collision Settles, Amount Undisclosed

On July 4, 2018, a motor vehicle collision occurred in Harris County, Texas, involving the plaintiffs and the defendant. The plaintiffs subsequently filed a lawsuit on August 13, 2020, alleging that the defendant negligently rear-ended their vehicle during rainy conditions. They claimed the defendant failed to maintain a proper lookout, control speed, ensure a safe distance, and take necessary precautions. The plaintiffs sought damages for alleged severe injuries, including past and future medical expenses, mental anguish, physical pain and suffering, loss of enjoyment of life, and lost earning capacity.

The defendant filed a general denial on October 29, 2020, contending that an unknown vehicle struck her from behind while she was stopped at a traffic light, pushing her into the plaintiffs' vehicle before fleeing the scene. The court granted the defendant's motion to designate this unknown driver as a responsible third party. The parties ultimately reached a settlement agreement. Following an Agreed Motion for Appointment of Guardian Ad Litem for the minor plaintiff, a guardian was appointed to review the settlement terms. After reviewing the agreement, the Guardian Ad Litem recommended approval for the minor. On April 19, 2022, the court approved the settlement, finding it reasonable, fair, just, and in the best interest of the minor plaintiff, with no admission of liability by the defendant. The settlement included a payment to the Registry of the Court, Harris County, for the minor's benefit. On June 7, 2022, the plaintiff filed a Notice of Non-Suit with prejudice, relinquishing all claims against the defendant.
