On September 29, 2016, a rear-end collision occurred on the 14800 block of Grisby Road in Harris County, Texas, when one vehicle struck the rear of another. The driver of the striking vehicle, who later became the defendant, received a citation for failure to control speed. In March 2018, the driver of the struck vehicle, the plaintiff, filed a lawsuit alleging the defendant's negligence. The plaintiff claimed the defendant failed to keep a proper lookout, apply brakes, maintain an assured clear distance, control vehicle speed, and exercise ordinary care. The plaintiff sought damages for medical expenses, physical pain, impairment, disfigurement, and lost income.
