Harris County Jury Awards $25,750 in Left-Turn Collision

On December 9, 2010, a collision occurred in west Harris County, Texas, at the intersection of Park Row Drive and Park Ten Boulevard. The plaintiff, an office cleaner, was driving a 1996 Nissan Pathfinder, and the defendant was driving a 2008 Ford F-250 pickup. Both vehicles were totaled when the defendant, attempting a left turn, collided with the plaintiff's vehicle. An orthopedic surgeon testified that future treatment might be necessary.

The defense disputed the extent of damages, emphasizing the plaintiff's reported pain-free status after initial treatment, significant gaps in medical care (including a 13-month period post-MRI), the small size of disc bulges, no immediate injury claims, and missed appointments. The defense also raised concerns about the plaintiff's testifying orthopedic surgeon's patient base and ownership of the injection facility.

After a two-day trial, the jury deliberated for four hours, awarding the plaintiff $25,750 for past medical bills, past physical pain and mental anguish, and past physical impairment. No future damages were awarded. With prejudgment interest, the final judgment totaled $30,515.51. The denial of future damages likely reflected the jury's consideration of the defense's arguments regarding treatment gaps and the plaintiff's documented recovery at various points.
