A rear-end motor vehicle collision occurred on March 18, 2023, in Fort Bend County, Texas. A driver and a minor passenger sustained injuries when their vehicle, traveling eastbound on Avenue H, was struck from behind by another vehicle. The plaintiff driver subsequently filed a lawsuit individually and on behalf of the minor passenger on November 28, 2023. The lawsuit alleged negligence against the driver of the striking vehicle and negligent entrustment against its owner.

The plaintiffs sought damages for medical expenses, physical pain, mental anguish, physical impairment, loss of earnings, property damage, and physical disfigurement. The defendants filed general denials, asserting defenses such as contributory negligence, pre-existing conditions, sudden emergency, and failure to mitigate damages.
