Case Overview
The Fort Bend Independent School District filed a lawsuit against a property owner to recover delinquent property taxes on a 2011 Toyota Sienna located in Fort Bend County, Texas. The taxing authorities, which included Fort Bend County, Fort Bend County Drainage District, Fort Bend County General Fund, and the City of Houston, sought to recover taxes for the years 2014-2019. They requested foreclosure of tax liens against the vehicle, a personal judgment against the owner, and an order for the property to be sold at public auction. The vehicle was valued at $10,080.
The defendant argued that the vehicle had been inoperable since a wreck in May 2014 and that the associated taxi business had subsequently closed. The defendant stated the vehicle had not received required state inspections, registration renewals, or city cab inspections for six years. In August 2020, Fort Bend County and other related entities intervened in the lawsuit to also recover their portion of the delinquent ad valorem taxes on the personal property.
Following a bench trial, the court issued a judgment in favor of the plaintiff taxing authorities on January 11, 2022. The court found that the cause of action was liquidated and ordered the defendant to pay delinquent taxes, penalties, interest, and attorney fees. The defendant was directed to pay $2,420.89 to Fort Bend Independent School District, $721.44 to Fort Bend County, and $734.13 to the City of Houston. An additional $303.00 was awarded to the various plaintiff entities on May 4, 2022, bringing the total award to $4,179.
