Ellis County Jury Awards $6,095,000 in 18-Wheeler Crash

On June 13, 2014, a multi-vehicle collision occurred around 5:30 a.m. on Interstate Highway 35 near Highway 387 in Ellis County, Texas. As traffic ahead slowed, an 18-wheel tractor-trailer, driven by an employee of Olmstead-Kirk Paper Company, struck a pickup truck occupied by the plaintiffs from behind. Witnesses reported the 18-wheeler continued at near highway speeds, striking several other passenger vehicles before and after the plaintiffs' truck, ultimately coming to rest in the median. Two other drivers also intervened in the case, alleging they were struck by the same 18-wheeler and sustained injuries.

The plaintiffs filed a lawsuit against the 18-wheeler driver, the driver's employer (Olmstead-Kirk Paper Company), and Salem Leasing Corporation. They alleged the driver was negligent for failing to keep a proper lookout, brake timely, and remain attentive. They further claimed Olmstead-Kirk Paper Company was negligent in its supervision, training, and auditing of drivers. The defendants denied the allegations, contending the plaintiffs were the sole proximate cause of their own injuries. The company and its driver also filed a cross-action against another driver involved in the incident, alleging that driver's intoxication, excessive speed, and failure to control his vehicle contributed to the overall damages.

Following a trial, a six-member jury returned a verdict in favor of the plaintiffs and intervenors. The jury awarded $6,095,000 in damages, along with post-judgment interest and court costs. The verdict indicated the jury found the defendants liable for the incident and the resulting injuries.
