Caldwell County Jury Finds Negligence, Awards $11,511 in Collision

A collision occurred in Caldwell County when the defendant, driving in an oncoming lane, attempted a left turn at a stoplight-controlled intersection. The right rear corner of the defendant's vehicle struck the front right corner of the plaintiffs' vehicle. A police report indicated the defendant failed to yield the right of way during an unprotected left turn. The plaintiffs, a married couple, subsequently filed a lawsuit alleging the defendant's negligence and claiming multiple injuries.

At trial, the plaintiffs contended the defendant admitted at the scene to having a solid green light, not a green arrow. The male plaintiff claimed hip misalignment and lower back pain, while the female plaintiff reported upper back and neck pain, seeking damages for medical bills and past pain and suffering totaling approximately $17,000-$18,000 for her and $7,000-$8,000 for him. The defense countered that the defendant had a green arrow, indicating she had the right of way, and alleged the male plaintiff was speeding. The defense also emphasized the male plaintiff's delay in seeking medical treatment and the police report showing no immediate injury for him.

After a two-day trial, the jury found the defendant negligent. The jury awarded the female plaintiff $11,011.32 for medical costs and an additional $500 for past pain and suffering, totaling $11,511.32. The male plaintiff received no award for his claimed injuries.
