A truck, operated by one defendant and owned by the New York City Department of Sanitation, subsequently struck the rear of the trailer. The collision pushed the trailer into the stopped vehicle and its driver, who claimed to have sustained injuries.
The injured driver sued the truck operator, the New York City Department of Sanitation, and the City of New York in the Supreme Court of New York, First Judicial District, New York County, on August 16, 2013. The lawsuit sought recovery for personal injuries resulting from the accident. The plaintiff filed a motion for summary judgment, which the court denied on November 8, 2013. The denial of summary judgment was later affirmed on appeal.
On December 30, 2015, the parties reached a settlement. The case concluded with a $1,500,000 payment to the plaintiff.
