Bronx County Rear-End Collision Injury Case Settles for $25,000

A vehicle operated by one defendant and owned by another defendant rear-ended an automobile operated by one plaintiff, in which a second plaintiff was a passenger, on the Bronx River Parkway in the County of Bronx, New York. The collision allegedly caused serious personal injuries, pain, and economic losses for the plaintiffs.

The plaintiffs subsequently filed a vehicular liability action in the Supreme Court of New York, Bronx County, alleging the defendants' negligence in operating their vehicle, including failure to control braking, yield, and adhere to traffic laws. The plaintiffs sought damages, costs, and interest. The defendants denied some allegations and asserted affirmative defenses, including culpable conduct, assumption of risk, and failure to mitigate damages. They also filed a counterclaim against the plaintiff-operator, alleging negligence and seeking indemnification, which the plaintiff-operator denied.

The parties, including the plaintiff-operator and both defendants, later settled the claims between them for $25,000. Following the settlement, a stipulation of discontinuance with prejudice was filed for the action regarding the plaintiff-operator and for the counterclaim against the plaintiff-operator.
