Gwinnett County Jury Awards $105,579 in Car Crash

On November 30, 2015, a motor vehicle collision occurred in Gwinnett County when a defendant failed to yield at a stop sign, striking the plaintiff's vehicle. The impact rendered the plaintiff's car a total loss. The plaintiff sustained multiple severe fractures to her right wrist and forearm, requiring emergency surgery. She also suffered soft tissue and nerve injuries, and injuries to her left knee and neck. Later, the plaintiff developed chronic pain and instability in her right shoulder, which necessitated extended physical therapy and additional surgery. The plaintiff's minor child suffered physical injuries including bumps, bruises, and muscle soreness, as well as psychological trauma. Both plaintiffs were transported to separate hospitals following the incident.

The plaintiff filed a complaint against the defendant, alleging negligence and seeking damages for her injuries. She claimed her academic performance and future employment opportunities were negatively affected by her inability to use her dominant hand. A claim was also filed on behalf of her minor child for injuries sustained.

The defendants initially admitted some allegations in March 2017, but later changed their position in July 2018, denying allegations they had previously admitted or stating they lacked sufficient knowledge. On March 27, 2019, a jury returned a verdict in favor of the plaintiffs. The jury's decision aligned with a traffic citation issued to the defendant by Gwinnett County Police for failure to yield.

The jury awarded the plaintiff $77,584.45 for her injuries and an additional $13,097.50 in general damages. The plaintiff was also awarded $14,897.50 on behalf of her minor child. On March 25, 2019, the court entered a judgment on the verdict, closing the case.
