Georgia Jury Awards $40,000 in Motor Vehicle Negligence

On August 25, 2016, a motor vehicle accident occurred at the intersection of Georgia Highway 400 and Mansell Road. The plaintiff filed a complaint on November 30, 2017, alleging the defendant's negligence was the sole cause of the collision. The plaintiff claimed the defendant was following too closely, failed to operate the vehicle safely, fell asleep while driving, and failed to maintain a proper lookout. As a result, the plaintiff reported personal injuries, lost earnings, and medical bills exceeding $50,000, along with physical, emotional, and psychological distress.

The defendant and an insurer presented several defenses, asserting the plaintiff failed to state a claim for which relief could be granted, failed to perform certain conditions precedent, and that the claims were barred by doctrines of settlement, release, accord, and satisfaction. They also challenged the court's jurisdiction, the sufficiency of service of process, and the venue. Additionally, the defense argued the plaintiff's failure to specifically state items of special damages, as required by Georgia law, barred their recovery.

The case proceeded to trial, and on February 12, 2019, a jury returned a verdict in favor of the plaintiff against the defendant, awarding $40,000 in general damages. The court subsequently entered judgment. On July 19, 2021, the insurer filed a motion to satisfy the judgment, which the court later determined had been fully satisfied, concluding the case.
