Georgia Judge Awards $14,523 in Motor Vehicle Negligence

On March 20, 2016, a motor vehicle collision occurred at the intersection of Washington Road and Stone Road. The plaintiff alleged the defendant negligently operated a vehicle by failing to maintain control, a vigilant lookout, and a reasonable speed, among other alleged violations of Georgia law. As a result, the plaintiff claimed to have suffered injuries requiring medical treatment, pain and suffering, and lost wages.

The plaintiff filed a complaint on December 15, 2017, after dismissing a previous action without prejudice. The lawsuit sought compensatory damages for medical expenses, pain and suffering, and lost wages, along with attorney fees and litigation expenses. The defendant asserted defenses, arguing that the plaintiff's damages were caused by other parties, that the defendant's actions did not contribute to the damages, and that the plaintiff failed to mitigate damages.

Following a bench trial, the court entered judgment for the plaintiff on June 20, 2018. The court awarded the plaintiff $14,238.00 in general damages and $285.19 in attorney fees and costs, for a total judgment of $14,523.19. This amount included compensation for medical bills, pain and suffering, filing fees, and subpoena fees.
