She claimed the tractor-trailer operator's negligence, specifically alleging a failure to maintain a proper lookout and an illegal lane change, caused the incident. The lawsuit targeted the operator, the vehicle's owner and associated entities, and their insurer, seeking compensatory and punitive damages. The defendants denied the allegations and asserted various affirmative defenses, including the negligence of a non-party.

The parties subsequently informed the court that the case had been settled for $333,333.33. The U.S. District Court then issued an order to administratively close the case, followed by a stipulated order of dismissal with prejudice. The plaintiff had initially sought $5,000,000.
