Fulton County, Georgia Rear-End Collision Negligence Settles

On December 2, 2016, a motor vehicle collision occurred on I-75/85 South near Martin Luther King Jr. Drive in Fulton County, Georgia. A driver, identified as the defendant, who had consumed alcohol and was operating a vehicle during employment, failed to maintain a proper lookout. The defendant's vehicle crashed into the back of the plaintiff's stopped vehicle, initiating a chain reaction collision. The plaintiff sustained injuries, received treatment from emergency medical services, and was transported to Grady Memorial Hospital, subsequently incurring over $26,500 in medical bills, along with lost wages and pain and suffering.

The plaintiff filed a lawsuit on February 5, 2018, alleging negligence and negligence per se against the defendant, citing failures such as following too closely and not adhering to basic rules of the road. The plaintiff sought damages for injuries, medical expenses, lost wages, and pain and suffering, as well as litigation costs. An uninsured/underinsured motorist carrier initially involved in the action was later dismissed without prejudice. The defendant was served but failed to file an answer within the mandated period. Following an initial denial, the court granted a motion for default judgment on September 1, 2018, finding the defendant liable for all issues.

The case proceeded through various motions, including the court's denial of the defendant's attempt to withdraw certain admissions and its approval of the plaintiff's request to amend the pre-trial order. The court also granted the plaintiff's motion for sanctions against the defendant. Ultimately, on January 20, 2020, the court issued a final order closing the case based on a settlement agreement reached between the parties, retaining jurisdiction to enforce the settlement terms if necessary.
