Clayton County Jury Awards $25,000 in Rear-End Collision

On August 17, 2016, a vehicle operated by the plaintiff was rear-ended by a vehicle driven by the defendant on Tara Boulevard in Clayton County, Georgia. The plaintiff filed a lawsuit in February 2017, alleging the defendant's negligence for following too closely, in violation of state law. The plaintiff claimed to have sustained bodily injuries, pain, and incurred over $10,000 in medical expenses, seeking both special and general damages.

The defendant responded with several defenses, including claims of insufficient service of process and lack of personal jurisdiction. An insurer involved in the litigation also asserted various affirmative defenses and contended that certain special damages sought by the plaintiff were unrecoverable due to lack of specificity.
