Atlanta Jury Finds Negligence, Awards $4,831 in Rear-End Collision

On August 2, 2017, a rear-end collision occurred on Stonewall Tell Road at Roosevelt Highway in Atlanta, Georgia. A vehicle operated by the defendant struck a stopped vehicle operated by the plaintiff. The defendant received a citation for following too closely. The plaintiff filed a lawsuit on May 14, 2018, alleging the defendant's negligence caused physical injuries, pain and suffering, medical expenses, emotional distress, and lost wages. The plaintiff sought damages totaling at least $20,917.90.

During the discovery phase, the court addressed several motions. A significant development occurred on November 19, 2019, when the court found that the plaintiff had destroyed her vehicle, which was evidence meaningfully linked to the case's merits, while contemplating litigation. The court determined this spoliation of evidence was harmful to the defendant and ruled, as a matter of fact and law, that the collision caused no damage to the plaintiff's vehicle.

Despite the spoliation ruling, the case proceeded to trial. On March 14, 2022, a jury found in favor of the plaintiff. The court entered judgment on April 6, 2022, awarding the plaintiff $4,831.00 in general damages, along with post-judgment interest. This award was substantially less than the $20,917.90 in damages originally sought by the plaintiff.
