Alpharetta Jury Awards $15,364.87 in Left-Turn Collision

On July 6, 2014, in Alpharetta, Georgia, a vehicle carrying the plaintiff as a front-seat passenger was struck by another vehicle. The defendant driver, traveling southbound on Webb Bridge Road, attempted a left turn into a parking lot and collided with the plaintiff's northbound vehicle.

The plaintiff filed a complaint on May 23, 2016, alleging the defendant negligently failed to exercise due care, maintain a proper lookout, yield the right of way, and made an improper left turn. The plaintiff also claimed negligence per se, citing a violation of O.C.G.A. § 40-6-71. As a result of the collision, the plaintiff claimed to have suffered injuries, incurred medical and rehabilitative expenses, experienced pain and discomfort, and faced diminished capacity to work and enjoy life.

The defendant responded on June 22, 2016, admitting involvement in the accident but denying all allegations of negligence, statutory violations, and the extent of the plaintiff's alleged injuries and damages. Before the trial, the court denied the defendant's motion to exclude an expert witness's testimony, deeming it untimely as discovery had concluded.

The case proceeded to trial, and on July 25, 2017, a jury in Alpharetta, Georgia, returned a verdict in favor of the plaintiff. The jury awarded $15,364.87 in damages, covering past medical expenses and pain and suffering. No future medical expenses were awarded.
