Case Overview
The parents and next of kin of a deceased passenger filed a wrongful death lawsuit against two establishment owners and the driver of the vehicle involved in a fatal collision in Albany, Georgia. The plaintiffs alleged that on July 2, 2013, one defendant, the driver, was served excessive amounts of alcohol at various nightclubs, including the defendant establishments, despite being visibly intoxicated and despite the establishments knowing she would be driving. On July 3, 2013, the passenger died in a motor vehicle collision in Albany, Dougherty County, Georgia, while riding with the driver. The driver later pleaded guilty to Homicide by Vehicle in the 1st Degree and other charges on December 12, 2014. The lawsuit sought judgment for the full value of the decedent's life, punitive damages against all defendants, and costs.
One defendant establishment owner filed defenses, arguing the complaint failed to state a claim, that any damages resulted from conduct for which they were not responsible, and that others caused the damages. This defendant also contended that the plaintiffs were not entitled to punitive damages and that damages should be apportioned based on fault under Georgia law.
On May 23, 2018, the court granted that establishment owner's motion to dismiss due to lack of service and the expiration of the statute of limitations. Subsequently, on June 12, 2018, a consent judgment was entered by agreement between the plaintiffs and the defendant driver for $900,000. The remaining defendants were dismissed without prejudice, concluding the case.
