Case Overview
In October 2004, a multi-vehicle collision occurred near Kings Highway and Veteran's Parkway in Port Charlotte, Florida. A defendant driver, operating a truck owned by a defendant company, failed to slow down, rear-ending a third vehicle. This impact pushed the third vehicle into the plaintiff's vehicle. At the time of the incident, the defendant driver's license was suspended. The plaintiff subsequently filed a lawsuit, alleging negligence by the defendants resulted in damages and injuries.
During the three-day trial, the plaintiff presented expert medical testimony to establish the extent and permanence of the alleged injuries. The defendants, in turn, presented their own expert medical testimony, disputing the permanence of the plaintiff's injuries. Prior to trial, the defendants had offered a settlement, which the plaintiff did not accept.
The jury deliberated for under four hours and determined that the defendant driver's negligence was a legal cause of damage to the plaintiff. However, the jury also found that the plaintiff did not sustain a permanent injury as a result of the accident, within a reasonable degree of medical probability.
