In June 2002, a collision occurred at the intersection of U.S. Highway 41 and C.R. 846 (Immokalee Road) in Naples. The plaintiff was in a stopped vehicle at a red traffic light when a vehicle, operated by a defendant driver and owned by a separate defendant, rear-ended the plaintiff's car. Emergency personnel assisted the plaintiff from the vehicle, who was then airlifted to Lee Memorial Hospital.
According to an arrest report, the defendant driver fled the scene on foot but was apprehended by Collier County Deputies. Following a field sobriety test, the driver was found to be operating the vehicle while under the influence of alcohol, with a blood alcohol level exceeding the state's legal limit. The defendant driver was subsequently charged, sentenced, and incarcerated in connection with the incident.
In the civil case that followed, an original defendant insurer reached a full settlement with the plaintiff and was dismissed in March 2004. Separately, the plaintiff settled with the vehicle owner in March 2004 for $9,500.
