Case Overview

On November 15, 2005, a vehicle operated by the plaintiff stopped at a red light at the intersection of CR 210 and I-95 in Jacksonville when it was rear-ended by a vehicle owned by the defendant vehicle owner and operated by its employee. The plaintiff alleged that after the initial impact, her vehicle was struck a second time on the back driver's side as she attempted to avoid colliding with the vehicle in front of her, pushing her into a curb. The vehicle in front of her was not struck.

The plaintiffs subsequently filed a lawsuit, alleging that the collision caused injuries. Both sides presented expert testimony from fields including pain management, neurology, orthopedics, and biomechanical engineering to address the plaintiff's alleged injuries and their cause.

Following deliberations, a jury determined that the plaintiff did not sustain a permanent injury as a result of the accident.
