Case Overview

On July 12, 1991, a three-vehicle collision occurred on Garden Street at the intersection of Baylen Street. A truck, owned by a corporate defendant, struck the rear of a Volkswagen. The impact propelled the Volkswagen into the back of an Oldsmobile. The plaintiff, a passenger in the Volkswagen, sustained injuries and subsequently filed a negligence claim against the truck driver and the truck owner, alleging the driver was acting within the scope of employment at the time of the incident.

The defendants admitted negligence for the accident. However, they contested the extent of the plaintiff's injuries, arguing that they did not meet the permanent injury threshold as required by F.S. 627.737. An orthopedic surgery expert from Pensacola provided testimony on behalf of the plaintiff regarding the injuries.

After hearing the arguments, the jury found that the plaintiff did not sustain a permanent injury. A motion for a new trial was pending following the verdict.
