Case Overview
On June 30, 1999, a collision occurred in Clearwater, Florida, when a vehicle traveling south on Belcher Road was rear-ended at the intersection with Montclair Road. The driver of the stopped vehicle, the plaintiff, subsequently filed a personal injury lawsuit against the driver of the striking vehicle, the defendant.
During the trial, the court granted the plaintiff's motion for a directed verdict regarding negligence and liability, establishing the defendant's responsibility for the collision. The case then proceeded to a jury to determine if the plaintiff had sustained a permanent injury as a result of the accident. Medical experts, including specialists in neurosurgery, neurology, and orthopedic surgery from Dunedin, St. Petersburg, and Tampa, testified for both sides regarding the plaintiff's injuries.
The jury concluded that the plaintiff did not sustain a permanent injury caused by the accident. Following the verdict, the plaintiff's motion for a new trial was denied. Both the plaintiff and the defendant filed motions for attorney's fees and costs. The case is currently on appeal.
