Denver Jury Awards $129,984 in Rear-End Collision

In Denver, Colorado, a multi-vehicle rear-end collision occurred when a driver allegedly struck a vehicle, forcing it into another occupied by a driver and a passenger, which was then pushed into a fourth vehicle. The driver and passenger of the second vehicle asserted they were stopped in traffic when the incident occurred and sustained injuries. The at-fault driver received a traffic citation for following too closely.

The injured driver and passenger filed a complaint in the Colorado Second Judicial District Court for the County of Denver, alleging vehicular negligence and negligence per se against the driver deemed at fault. The plaintiffs presented claims for economic losses, while the defendant raised affirmative defenses, including failure to mitigate damages, pre-existing injuries, and failure to use a safety belt.

Following a jury trial, the jury returned a verdict in favor of the plaintiffs. A judgment was entered for total damages of $129,984, which included principal and prejudgment interest. Subsequently, the court also granted stipulated bills of costs, awarding the plaintiff driver $7,101.74 and the plaintiff passenger $10,794.50.
