Colorado Uninsured Motorist Coverage Dispute Settles for $15,000

On October 31, 2010, two vehicles collided in Colorado, resulting in physical injuries to one driver, the plaintiff. The other driver was uninsured. The plaintiff subsequently filed an uninsured motorist claim with her insurance carrier, the defendant. The defendant failed to make payments for the plaintiff's injuries, leading the plaintiff to file a complaint on October 8, 2012, in Colorado District Court, Eighteenth Judicial District.

The plaintiff alleged breach of contract for her uninsured/underinsured motorist coverage, seeking compensation for past and future economic losses, medical expenses, permanent impairment, suffering, and loss of enjoyment of life. The defendant insurer responded on December 19, 2012, arguing that the plaintiff failed to state a claim, did not mitigate her damages, and that any claims were barred or reduced by comparative negligence.

On June 9, 2015, the parties filed a notice of settlement. The terms stipulated that the defendant would pay $15,000 to the plaintiff. As part of the agreement, the plaintiff agreed to indemnify the insurer from any liens or subrogation claims. A stipulation for dismissal with prejudice was filed on September 19, 2015, which the court granted the same day, formally closing the action.
