Following the incident, on December 5, 2008, the injured driver, who became the plaintiff, requested insurance policy information from an adjuster for the vehicle owner's insurer. The adjuster provided a policy on January 19, 2009, indicating a per-person liability limit of $250,000.

The plaintiff and her husband filed a negligence complaint on July 1, 2010, in the Arizona Superior Court, Maricopa County, against the driver and vehicle owner, along with their respective spouses, who became the defendants. In December 2010, the defendants accepted the plaintiffs' $250,000 offer of judgment.
