Denton Jury Awards $75,000 in Motor Vehicle Negligence Trial

On October 5, 2015, a motorcycle operator collided with a sport utility vehicle in Denton. The plaintiff, who was operating the motorcycle, alleged the defendant pulled out suddenly from a parked position along the curb. Police at the scene noted "improper start from parked position" as a contributing factor for the defendant. The plaintiff subsequently filed a lawsuit alleging the defendant was negligent in operating the vehicle.

The plaintiff claimed to have sustained a sprained left wrist, minor joint effusion in a left knee, and pain in the left hip, neck, and lower back. Medical treatment included an emergency room visit, a wrist brace, and a pain management evaluation approximately three weeks after the incident. The plaintiff testified to ongoing pain and limitations in daily activities. During trial, the plaintiff and two eyewitnesses stated the defendant's vehicle was in motion at the time of impact. The plaintiff's counsel sought $17,000 for past medical expenses and additional unspecified damages for pain and impairment.

The defendant, whose deposition was read to the jury, claimed to have stopped after pulling away from the curb for several seconds before the plaintiff lost control and slid into the SUV. The defense argued the accident and injuries were minor, citing photos showing minimal vehicle damage and the plaintiff's ability to walk at the scene. The defense also questioned the claims of neck and back injuries due to a lack of supporting medical records or bills. Prior to trial, the parties entered a high-low agreement with parameters of $100,000 and $15,000.

After a one-day trial, the jury deliberated for two hours before finding the defendant liable for the accident. The jury did not find the plaintiff negligent and awarded the plaintiff $75,000.
