Harris County Jury Awards $4,898,049.86 in Multi-Vehicle Accident

A motorist from Katy, Texas, filed a lawsuit after a multi-vehicle accident on December 21, 2019, on the Katy Freeway in Harris County. The incident occurred when one defendant made an unsafe lane change, prompting a tractor-trailer, operated by a second defendant and employed by a third, to rear-end the plaintiff's vehicle. This impact pushed the plaintiff's vehicle into the first defendant's. The plaintiff sustained serious injuries and sought damages for medical expenses, pain, and impairment, alleging the third defendant was liable under respondeat superior.

The first defendant denied fault and claimed the plaintiff's contributory negligence. The second and third defendants asserted the first defendant was solely responsible. All defendants also invoked a state statute limiting medical expense recovery to amounts actually paid or incurred. Following a jury trial, the plaintiff prevailed against all defendants. On April 5, 2023, the court entered judgment, awarding the plaintiff $3,918,445.48 against the first defendant and an additional $979,604.38 jointly from the second and third defendants.
