One driver was traveling behind another on a highway when the lead driver cut in front of the trailing vehicle to exit. Case Overview

On September 3, 2013, a multi-vehicle collision occurred on eastbound Highway 121 in Fort Worth, Texas. A plaintiff, driving a Kia Soul, was traveling behind another plaintiff, who was in a Buick Rendezvous. A defendant, operating a Mini Cooper, allegedly cut in front of the Kia Soul from the left middle lane to reach an exit ramp. The Kia Soul rear-ended the Mini Cooper and then swerved left, where it was subsequently rear-ended by a Nissan Sentra. A fourth vehicle, a Ford Escape, then swerved right and struck the side of the Buick Rendezvous, which then hit a concrete barrier. A police report attributed fault for the initial incident to the Mini Cooper driver for an unsafe lane change.

The plaintiffs, who claimed multiple injuries, filed suit alleging negligence. The driver of the Kia Soul initially sued the Mini Cooper driver, claiming negligent lookout and unsafe lane change. The Buick Rendezvous driver intervened as a plaintiff, and both plaintiffs added claims against the Nissan Sentra driver and the Ford Escape driver. The Ford Escape driver was later nonsuited, and the Nissan Sentra driver settled before trial, paying $11,000 to the Kia Soul driver and $750 to the Buick Rendezvous driver. The case proceeded to trial against the Mini Cooper driver only.

The Mini Cooper driver contended she had been in the right middle lane the entire time and that the Kia Soul driver simply rear-ended her. For the Kia Soul driver's claims, the jury found both the Mini Cooper driver and the Nissan Sentra driver negligent, assigning 75 percent comparative responsibility to the Mini Cooper driver and 25 percent to the Nissan Sentra driver. The jury awarded the plaintiffs a total of $80,040.92, for which the Mini Cooper driver was held liable. With prejudgment interest and taxable costs, the total recovery for the plaintiffs amounted to $93,786.58.
